Instant application has been filed under Section 9 of the Arbitration and Conciliation Act, 1996, seeking appointment of an Advocate Commissioner to seize and take possession of the vehicle, which is more fully described in the schedule to the Judges summons which is lying in the custody of respondent or respondent's men, agents, servants from his premises or wherever found with Police aid and break open of premises, if necessary.

2. Mr.N.Santhosh Nagarajan, learned counsel appearing for the applicant submitted that vehicle has been seized by the Commissioner and the matter is settled. Hence he seeks permission of this Court to withdraw the instant application.

3. In view of the above, A.No.4232 of 2019 is dismissed as withdrawn. Mr.S.Cholarasan, Advocate Commissioner shall be paid an additional remuneration of Rs.10,000/- (Rupees Ten thousand only). 26/8/2020 mvs.
