The petitioner, who was arrested and remanded to judicial custody on 05.08.2021 for the offences punishable under Sections 5(m) and 6 of Protection of Children from Sexual Offence Act, 2012 in Spl.S.C.No. 04 of 2022 on the file of the Sessions Court, Mahila Court, Perambalur, seeks bail.
2. The case of the prosecution is that the petitioner herein committed penetrative sexual assault on the victim girl aged about 4 years. Hence, the complaint.
3. On perusal of the statement recorded under Section 164 of Cr.P.C. revealed that the victim girl is aged about 4 years. She categorically stated that the petitioner had committed penetrative sexual assault on the minor victim girl.
4. Therefore, the petitioner had committed a very serious and heinous offence as against the victim minor victim girl. Hence, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition is dismissed. Further, the trial Court is directed to complete the trial within a period of six months.
