COMMON JUDGMENT (Delivered by the Hon'ble Chief Justice) By these writ appeals, a challenge is made to the common interim order of the learned Single Judge dated 05.08.2021, whereby the following direction was given:
"24. Having regard to the peculiar facts and circumstances and reasons above stated, Tamil Nadu Public Service Commission is directed to publish the marks obtained by all the candidates, who participated in the selection. Tamil Nadu Public Service Commission is directed to prepare a merit list in the order of marks obtained in the written examination and the precise reasons for rejecting the candidature of participants, whose names are not found in the list of 226, excluding the names of candidates, who have not secured the minimum marks set for selection."
2. Learned counsel for the Tamil Nadu Public Service Commission submitted that the direction quoted above is in conflict with the judgment of the Apex Court in the case of Pranav Verma and others v. Registrar General of the High Court of Punjab and Haryana at Chandigarh and another, (2020) 15 SCC
377. Paragraph 28 of the judgment was referred in specific to show the consequences of declaration of result of the written examination before the viva-voce. A reference of the judgment of the Full Bench of this Court in the case of Vidya Devarajan v. The Secretary, TNPSC, 2020 (3) CTC 769 : 2020-2-L.W. 1 has also been given for the same proposition as laid down by the Apex Court in the case of Pranav Verma (supra). Accordingly, a prayer is made to set aside the interim order passed by the learned Single Judge.

The appeals are seriously opposed by learned counsel for the non-appellants/writ petitioners by referring to various illegalities and irregularities in the selection, that too, when it is challenged not on one ground, but on various grounds. Thus, to ensure that the selection process is fair, the learned Single Judge has given appropriate direction for declaration of the result of the written examination and also it is in the given facts and circumstances of the case.

It is, however, submitted by learned counsel for the non-appellants/writ petitioners that if the direction therein is opposed to the judgment of the Apex Court in the case of Pranav Verma (supra) and the judgment of the Full Bench of this Court in the case of Vidya Devarajan (supra), the appeals may be disposed of with a request to the learned Single Judge to finally hear and decide the pending writ petitions at the
earliest with liberty to the non-appellants/writ petitioners to raise all issues for challenge to the selection, which may then be threadbare considered by the learned Single Judge. If the direction aforesaid is given, the non-appellants/writ petitioners would not have objection for setting aside the interim order for declaration of the result of the written examination. However, this no-objection may not be taken adverse to the non-appellants/writ petitioners. Rather, it is in the given facts and circumstances only, otherwise, they support the order of the learned Single Judge.
5. However, learned counsel appearing for the Tamil Nadu Public Service Commission did not support the aforesaid course of action suggested. He submitted that the order passed by the learned Single Judge runs contrary to the view expressed by the Apex Court in the case of Pranav Verma (supra) and the Full Bench of this Court in the case of Vidya Devarajan (supra).

Inasmuch as all learned counsel for the nonappellants/writ petitioners, in one voice, submitted that the interim order of the learned Single Judge may be set aside with a clarification that the non-appellants/writ petitioners can raise all the issues before the learned Single Judge. The learned Single Judge may decide all the issues on merit.

In view of the above, we are inclined to cause interference with the order of the learned Single Judge only to the extent of the direction for declaration of the result of the written examination prior to viva-voce, as it is otherwise hit by the judgment of the Apex Court in the case of Pranav Verma (supra).
8. Accordingly, the interim order of the learned Single Judge impugned herein is set aside. However, the judgment herein would not be taken to be adverse to the nonappellants/writ petitioners in any respect and they would be at liberty to raise all the issues which would be considered by the learned Single Judge for passing final order. The learned Single Judge would be requested to expedite the hearing. Learned counsel appearing for the parties are directed to cooperate with the learned Single Judge for final hearing.
9. With the aforesaid clarification and observation, the part of the order of the learned Single Judge directing the declaration of the result of the written examination is set aside. It is with a request to the learned Single Judge to expedite the hearing and for that, the Registry is directed to list all the writ petitions before the learned Single Judge on 31.03.2022.
