PRAYER:

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the respondent's to depute a surveyor to measure the petitioner's property situated in S.No. 52/1, Vanjur Village, Katpadi Taluk, Vellore District and to name transfer the patta in the petitioner's name.

ORDER

The petitioner made a representation on 09.11.2013 to the respondent No. 1, seeking to survey his land and transfer Patta in his name, based upon the sale deed executed in his favour on 13.07.2011. Thereafter, the respondent No. 2 forwarded the petitioner's application made earlier on 06.08.2013 to the respondent No. 1. As there was no further action forthcoming on the part of the respondent No. 1, the petitioner made one more application to the respondent No. 1 on 17.10.2015. As the said application is pending consideration before the respondent No. 1, the present writ petition has been filed by the petitioner before this Court.

3. Considering the pendency of the application of the petitioner dated 06.08.2013, which was forwarded to the respondent No. 1 on 31.01.2014, by the 2nd respondent and subsequent application made to the 1st respondent on 17.10.2015, which is also pending consideration, the respondent No. 1 is directed to consider the applications of the petitioner and pass appropriate orders on the same, within a period of eight weeks from the date of receipt of copy of this order, after affording an opportunity of hearing to the petitioner as well as other parties, if any.

4. With the above direction, the writ petition is disposed of. No costs.
