PRAYER :

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the 1st respondent to survey the patta land in vide survey No. 169/3cl in pulical village, Dharmapuri District, based on petitioner's representation dated 21.07.2015. For Petitioner : Mr.M.Ravi, For Respondent 1: Mr.V.Subbiah, Special Government Pleader

ORDER

It is the specific case of the petitioner that an extent of 0.17 cents of land in survey No. 169/3c1, situated in Pulical Village, Dharmapuri District, belongs to him. It is the further case of the petitioner that the same is allegedly encroached by one Mr.Pachiyappan, the 2nd respondent herein. Thus, the petitioner made a representation to the respondent No. 1 on 21.07.2015, seeking to measure the said property. As the said representation is pending consideration, the petitioner has filed the present writ petition before this Court.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondent No.1. Though the petitioner sought for a larger prayer, learned counsel for the petitioner submitted that it would suffice if the representation dated 21.07.2015, is directed to be considered by the respondent No. 1.

3. Considering the pendency of the representation of the petitioner and without going into the merits of the case, the respondent No. 1 is directed to consider the representation of the petitioner dated 21.07.2015 and pass appropriate orders on the same, within a period of eight weeks from the date of receipt of copy of this order, after affording an opportunity of hearing to the petitioner as well as the 2nd respondent.

4. With the above direction, the writ petition is disposed of. No costs.
