This petition has been filed to set aside the condition totally as imposed by the Learned Judicial Magistrate No.1, Mannargudi in C.M.P.No.2965 of 2016 on 26.04.2016.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is seen that the petitioners are accused in Crime No.87 of 2016 for offences under Sections 147, 294(b), 406, 420, 506(1) of IPC and they were arrested on 29.01.2016 and released on 10.02.2016 by the Learned Judicial Magistrate No.1, Mannargudi on condition that they should report before the respondent police daily at 10.00 a.m. Thereafter, the condition was modified on 02.03.2016 with a further direction, that they https://hcservices.ecourts.gov.in/hcservices/

should report on 1st and 15th of every month at 10.00 a.m. and by order dated 26.04.2016, the learned Judicial Magistrate No.1 has further modified the condition with a direction to the petitioners that they should appear before the respondent police on the first monday of every month at 10.00 a.m, against which the petitioners are before this Court.

4. The fact remains that the investigation is in progress and therefore, the direction to the petitioners to report once in a month cannot said to be wrong. In the light of the above, there is no merit in this petition. Accordingly, this petition is dismissed.
