This Civil Miscellaneous Appeal has been filed to set aside the order dated 08.02.2013 made in M.C.O.P.No.403 of 2008 on the file of the Motor Accident Claims Tribunal, Tiruchengode.

2. The appellant is the claimant in M.C.O.P.No.403 of 2008 on the file of the Motor Accident Claims Tribunal, Tiruchengode. He filed the above said claim petition, seeking to pass an award for a sum of Rs.3,00,000/- as compensation with interest and cost.
3. The Tribunal, considering the pleadings, oral and documentary evidence, dismissed the petition.
4. Not being satisfied by the Judgment of the Tribunal, the appellant has come out with the present appeal seeking to set aside the order of the Tribunal.
5. On perusal of the Docket order, it appears that on 27.08.2020, Mr. C. Paranthaman, the learned counsel for the claimant undertook to file Vakalat. After so many adjournments, on 22.06.2023, Mr. C. Paraneedharan, the learned counsel, undertook to file Vakalat for the appellant. The case was posted on 18.08.2023 under the caption "for dismissal". Till today, no Vakalat has been filed for the appellant. Therefore, this C.M.A. stands dismissed for non-prosecution. No costs.
