When the matter is taken up for hearing, there is no appearance on behalf of the petitioner.

2.This original petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the debt of A.Victor Frank, the brother of the petitioner. He died intestate on 22.06.2020 as a bachelor. The petitioner is his sole Class II legal heir.

3.After necessary procedures were completed, the petitioner was invited to adduce evidence. The petitioner examined herself as PW-1. Her Identity Card and Adhaar Card were marked as Exs.P1 and P2. The death certificate of her father Arulanandam was marked as Ex.P5. The death certificate of her brother A.Victor Frank was marked as Ex.P6. The death certificate of her mother Caroline was marked as Ex.P7. The relationship certificate between the petitioner and her deceased brother, A.Victor Frank, was marked as Ex.P8. Indian Bank were marked as Exs.P10 to P20.

smv 4.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate is to be issued in the name of the petitioner, Mary Magdalane.
