ORDER

This Criminal Original Petition is filed to modify the condition imposed in Para No.5, by the learned IV Additional District Judge at Thiruvallur at Ponneri, vide order dated 09.12.2024 made in Crl.M.P.No.807 of 2024 in SC.NO.415 of 2024.

2. Learned counsel for the petitioner would submit that the petitioner was remanded to judicial custody on 18.06.2024 on the NBW issued by the Judicial Magistrate No.II, Ponneri, under Sections 341, 302,120(B), 109 of IPC in Crime No.593 of 2021. The learned IV Additional District Judge at Thiruvallur @ Ponneri have granted bail to the petitioner with one of the condition to furnish two sureties of each Rs.25,000/-, one surety being blood relative of the petitioner/accused to the satisfaction of the Court and the petitioner/accused should appear and sign before the court regularly by 10.00 A.M., for one month on all working days. However, due to petitioner's dire financial situation and limited means, he was unable to execute the sureties. Hence, the petitioner is before this Court by way of this petition, seeking to modify the condition

imposed on him.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police confirmed the above said facts.

4. Heard both sides.

5. Considering the submissions of both sides, this Court is of the view that the conditions imposed on the petitioner in Crl.M.P.No.807 of 2024 in SC.No.415 of 2024, on 09.12.2024, by the learned IV Additional District Judge, Thiruvallur at Ponneri Court is modified as follows: "The petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate II at Ponneri."

The other conditions imposed in the order dapted 09.12.2024 in Crl.M.P.No.807 of 2024 in SC.No.415 of 2024, shall remain unaltered.

6. Accordingly, the Criminal Original Petition is ordered, and the condition is modified.
