Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.V.BALAMURUGANE, Advocate for the petitioner, the court made the following order:- This Civil Miscellaneous Petition has been filed by the petitioners/appellants seeking to condone the delay of 526 days in re-presenting the Second Appeal case papers in S.A.SR.No.76050 of 2018.
2.The learned counsel for the petitioners/appellants submitted that this petition may be allowed on cost.
3.Considering the reasons stated in the affidavit filed in support of the petition, this Court is inclined to condone the delay subject to the condition, that the petitioners/appellants shall pay a cost of Rs.5,000/- (Rupees Five Thousand only) to the Tamil Nadu State Legal Services Authority, High Court of Madras, within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically without any further reference to this Court. 4.In the event of payment of cost, the Registry is directed to number the S.A.SR.No.76050 of 2018, if it is otherwise in order. -sd/- 29/09/2021 / TRUE COPY / Sub-Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
