This case came up for settlement before the Lok Adalat. Both parties are present. Mr.P.Sankara Narayanan for M/s.R.Sreevidhya, learned counsel Appellant and the respondents are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.7,66,960/- with interest at 7.5% per annum from the date of filing of this petition till the date of deposit with costs.

2. The Appellant is the Insurer. The respondents 1 to 6 are the claimants. The M.C.O.P was filed seeking compensation to the tune of Rs.20,00,000/- for the death of the mother of the claimants in the Motor Accident on 20.05.2015. The Tribunal has awarded a sum of Rs.7,66,960/-. Aggrieved by the said award, the appellant/Insurance Company has preferred the above Civil Miscellaneous Appeal.

3.Today, the learned counsel for the appellant / Insurance Company and the claimants / the respondents 1 to 6 are present. They had a discussion regarding modality of amicable settlement and arrived at a sum of Rs.7.25 Lakhs together interest and cost out of which, 50% of the award amount is already deposited by the appellant. The respondents 1 to 6 shall be at liberty to seek payment out of the said amount with accrued interest by filing appropriate application without formal permission petition. Insofar as the balance

shall be deposited by the appellant/Insurance Company together with proportionate interest at the rate of 7.5% within a period of six weeks from the date of receipt of a copy of this order.

4. On such deposit, the respondents 1 to 6 are at liberty to withdraw the modified award amount in equal proportion without filing any formal petition before the Tribunal. Award is passed accordingly.

5. The Tribunal is directed to issue the cheque to the party concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. Consequently, connected Miscellaneous Petition is closed.
