The petitioner, who apprehends arrest for the alleged offences punishable under Sections 420, 465, 467, 468 and 471 IPC r/w Section 8 of Prevention of Corruption (Amendment Act), 2018 in Crime No.4 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case, as if he fabricated official cover address R.D.O., Gudiyatham, giving permission to quarry gravel sand. He further submitted that the petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted that petitioner delivered an forged official cover addressed by the Despatch Clerk, Geology and Mining Department, Vellore to R.D.O., Gudiyatham, granting permission for quarrying gravel sand, and https://www.mhc.tn.gov.in/judis

gd defacto complainant also found bunch of Rs.100/- currency notes in it. However, during preliminary enquiry, it was revealed forged signature of Assistant Director, Geology and Mining Department and fabricated the order , as if, permission was granted on 19.02.2024 by the Assistant Director. But the person who signed this letter was already transferred in December 2023 itself. With an intention to harass the RDO, the cover with letter and money was given by this petitioner. Thus, he vehemently opposed for the grant of anticipatory bail to the petitioner.

4.On seeing the fact that, in that alleged letter, there is a signature of Assistant Director, Geology and Mining Department dated 19.02.2024, but he was transferred in the month December 2023, this Court is of the view that this case needs detailed investigation and not inclined to grant anticipatory bail to the petitioner.
