Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the 2nd respondent to consider and pass orders on petitioner representation dated 29.12.2015 made to set right the pay of anomaly by fixing the revised Scale of Pay at Rs.9100 - 18600 + 5400 = Rs.24060 within a time frame as may be fixed by this Court.

The relief sought for in this writ petition is for a direction to consider the representation submitted by the writ petitioner on 29.12.2015, in order to set right the pay anomaly of the writ petitioner in the revised scale of pay. https://hcservices.ecourts.gov.in/hcservices/

2.The learned counsel for the petitioner contended that the writ petitioner is working as Headmaster in the Municipal Elementary School and retired from service on 30.6.2010 on attaining the age of superannuation. However, the pay of the writ petitioner was not revised in accordance with the Government Orders and the Rules and in this regard the writ petitioner submitted representations to the second respondent on 29.12.2015 & 7.5.2014, and till date no final order has been passed. Hence, the petitioner has come forward with this Writ Petition for the aforementioned prayer.

3.Without going into the merits and demerits of the matter, the second respondent is directed to consider the representation by the writ petitioner dated 7.5.2014 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of the copy of this order. The petitioner is directed to submit the copy of the representation along with the copy of the order passed today in this writ petition to the second respondent forthwith. No costs.
