This Second Appeal filed under Section. 100 of C.P.C. against the judgment and decree in A.S.No. 589 of 2008 passed by the V - Additional City Civil Judge at Chennai dated 23.09.2011 reversing the judgment and decree in O.S.No. 1695 of 1996 passed by the XI - Assistant City Civil Judge at Chennai dated 13.08.2007.

2. Ms.S.Akila representing Mr.S.Parthasarathy, learned counsel for the appellant would submit that they have returned the papers with the consent for change of Vakalat six months ago. No new counsel had entered appearance. It is clear that https://hcservices.ecourts.gov.in/hcservices/

the appellant is not interested in prosecuting the appeal. Hence, this appeal is dismissed for non-prosecution. Consequently, connected miscellaneous petition is closed. No costs.
