ASHA CMP No.13288 of 2019 in CRP(PD).NO.1528 of 2019 VINAYAGAM [ PETITIONER ] Vs ARCHANA [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition to deposit the arears of maintenance as well as continue to pay maintenance till disposal of this CRP for a sum of Rs.15,000/- per month as imposed in para No.4 of the interim stay order dated 27-04-2019 granted in CMP.No.9978/2019 in CRP.No.1528/2019, on the file of this Honourable Court (in CMP.13288/2019) in CRP(PD).No.1528/2019.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MANOHARAN N., Advocate for the petitioner and of Mr. E.C. RAMESH, ADVOCATE on behalf of the Respondent the court made the following order:- The above petition is filed for modifying the order of this Court dated 27.04.2019, in and by which the stay was granted on condition that the respondent should pay arrears of maintenance and to continue to pay the maintenance of Rs.15,000/- per month subject to the ultimate result in the Civil Revision Petition. The Trial Court ordered a sum of Rs.20,000/- towards the interim maintenance. This Court reduced the monthly maintenance to a sum of Rs.15,000/- subject to the outcome of the Revision.

Admittedly, the daughter of the petitioner and the respondent is in the care and custody of the mother. In these circumstances, I do not find any reason for modifying the earlier order dated 27.04.2019. The petitioner shall comply with the earlier orders of this Court within a period of https://hcservices.ecourts.gov.

four weeks from the date of receipt of a copy of this order. The Civil Miscellaneous Petition is dismissed.
