This is the Second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 08.06.2022 for the offences punishable under Sections 366 of IPC r/w Sections 5(1), 6 of POCSO Act, 2012 in crime No.470 of 2022 on the file of the respondent police.

2. The case of the prosecution is that the petitioner aged about 30 years, who is a married man had compelled the victim girl and committed penetrative sexual assault on her. Hence, the de-facto complainant who is the father of the victim girl had lodged a complaint.

3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.15650 of 2022, on 06.07.2022, considering the gravity of the offence committed by the petitioner which is heinous in nature.

4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
