It is submitted by the learned Government Advocate (Criminal Side) that there is neither a case registered nor a petition enquiry is pending against the petitioners.

Recording the submission made by the learned Government Advocate (Crl. side), this Criminal Original Petition is dismissed.

4. However, whenever summons are issued, the petitioners are entitled to appear before the respondent police and participate in the enquiry. This observation will not preclude the respondent police from taking necessary action in accordance with law if any offence is said to have been committed by the accused.
