PRAYER:

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the respondent No. 2 to issue the legal heir certificate of Chinnamma, who died on 09.01.2005. For Petitioners : Mr.K.Shanmugakani, For Respondents : Mr.Digvijay Pandian, Addl. Government Pleader

ORDER

In pursuant to the death of one Chinnamma on 09.01.2005, the petitioners claiming to be the legal heirs, made a request for issuance of legal heir certificate. The petitioners made an application to the respondent No. 2 on 16.09.2014. As the said application is yet to be considered, the petitioners have filed the present writ petition before this Court.

2. Heard the learned counsel for the petitioners and the learned Additional Government Pleader for the respondents.

3. Considering the above facts, the prayer sought for by the petitioners cannot be granted, since it is a matter to be considered by the respondent No. 2 after due enquiry. Thus, it is suffice to direct the respondent No. 2 to consider the application of the petitioners dated 16.09.2014 and pass appropriate orders on the pending application, within a period of eight weeks from the date of receipt of copy of this order, after conducting due enquiry.

4. With the above direction, the writ petition is disposed of. No costs.
