Prabhu v. State Rep By

2022-07-22Honourable Dr Justice G. Jayachandran1 pages

Crl.O.P.No.16618 of 2022 Dr.G.JAYACHANDRAN, J.

It is a case of abduction and demand of ransom. Totally 7 persons are arrayed as accused, so far the respondent police has secured only A6 and A7 and they were granted bail subsequently. Two other accused A1 and A2 granted anticipatory bail. A3, A4 and A5 are absconding and this petitioner is A5.

2. Earlier when the matter came up for consideration, this Court dismissed the anticipatory bail petition on 19.04.2022, considering the fact that the arrested accused have implicated this petitioner as one of the conspirators in the crime of abducting one Saravanan and extorting Rs.35 lakhs from him.

3. The gravity of the offence requires custodial interrogation, grant of anticipatory bail of other two accused or bail to A6 and A7 shall have no bearing in view of non recovery of the alleged money extorted from the defacto complainant. Hence, the Criminal Original Petition is dismissed.
