O R D E R
This Criminal Original Petition was referred for Mediation to Tamil Nadu Mediation and Conciliation Centre, High Court, Madras.
2.A communication dated 23.06.2015 of the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, enclosing a copy of its report dated 10.06.2015 has been received, wherein it is stated as follows:- "Both parties appeared before the Centre.
Parties arrived at an amicable settlement as per the terms in the Mediation Agreement enclosed herewith. Hence the matter is sent back to the Hon'ble Court.
3.As the parties have arrived at a settlement in terms of the Mediation Agreement, dated 10.06.2015, this Criminal Original Petition is listed for passing of an order in terms of the settlement. 4.The Mediation Agreement, dated 10.06.2015, arrived at out of their own volition and without any pressure or coercion from any side, signed by the parties and their respective counsel reads as follows:- "1. Petitioners and Defacto Complainant settle the dispute amicably between them.
2. 1st Petitioner and Defacto Complainant agree to live together happily before the Mediation Centre.
3. Defacto Complainant agreed to withdraw the Complaint filed against the Petitioners before the Respondent/ Inspector of Police, W-21, All Women Police Station, Guindy, Chennai."
5. The terms of settlement arrived at between the parties which is recorded under the Mediation Agreement by the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, in its Report dated 10.06.2015, is recorded. The Mediation Agreement and the report of the Mediation Centre shall form part of this order.
6. Today, when the matter is taken up, Mr.V.Vijayakumar, learned counsel appearing for the petitioners has submitted that the dispute has been amicably settled between the parties and that the first petitioner/husband and the defacto complainant have joined together and they agreed to live together happily and peacefully before the Mediation Centre and hence, he sought the permission of this Court to withdraw this case. In view of the above submission and endorsement made by the learned counsel appearing for the petitioners, this Criminal Original Petition is dismissed as withdrawn. 25.06.2015 paa To The Inspector of Police W-21, All Woman Police Station Guindy, Chennai.
