ORDER

This criminal original petition has been filed seeking to call for the records in C.C.No.226 of 2014 pending on the file of the Learned Judicial Magistrate-III, Coimbatore and to quash the same.

2.The learned counsel appearing for the petitioner would submit that without going into the merits of the case, it would suffice, if this Court issues direction to the Trial Court to expedite the trial and complete the same as early as possible. He would further submit that the appearance of the petitioners before the Trial Court may be dispensed with and would further submit that the petitioners are ready to appear as and when necessary.

3.Though there is no representation on half of the respondent, this Court directs the learned Judicial Magistrate-III, Coimbatore, to expedite the trial in C.C.No.226 of 2014 and complete the same as early as possible, if not disposed already, within a period of six months from the date of receipt of copy of this order.

4.Taking into consideration the request as made by the learned counsel for the petitioner, the appearance of the https://hcservices.ecourts.gov.in/hcservices/

petitioner before the trial Court is dispensed with except for their appearance for the purpose of receiving the copy of the proceedings under Section 313 of Cr.P.c and on the day on which judgement is to be pronounced. However, if for any particular reason, the presence of the petitioners is necessary, the trial Court, at its wisdom, shall direct their appearance on those days.

5.With the above directions, this criminal original petition is disposed of. Consequently, connected miscellaneous petition is closed.
