O R D E R

This petition has been filed to pass an order to dispose STR No.5364 of 2012 on the file of the learned Judicial Magistrate-II, Puducherry within a time frame fixed by this Honourable Court.

2. Heard the learned Additional Public Prosecutor [Pondy] and perused the materials placed on record.

3. When the case was taken up for hearing, there was no representation for the petitioner. Prayer in the petition for a direction to the Judicial Magistrate II, Puducherry to complete the trial in STR.No.5364 of 2012 within a time frame.

4. This Court called for report from the learned Judicial Magistrate II, Puducherry and the report dated 08.06.2015 has been received. In the said report, the learned Magistrate has stated that the case is posted to 26.06.2015 for the cross-examination of PW1 finally. The learned Magistrate has also stated as follows: "I submit that 3573 cases are pending before this Court. Hence short hearing dates could not be given in this case. I further submit that in this case, both parties are very irregular in attending the Court. Hence the case could not be disposed off so far. Thus I submit my report to the above cited reference No.2." https://hcservices.ecourts.gov.in/hcservices/

5. In view of the above, the learned Judicial Magistrate II, Puducherry is directed to dispose of STR No.5364 of 2012, within a period of six months, from the date of receipt of a copy of this order. The learned Magistrate shall take coercive steps, if the accused does not co-operate in the conduct of the trial.

6. With the above observation, this Criminal Original Petition is closed.
