A Memo has been filed by the learned counsel for the petitioner, which is dated 18.08.2023. As seen from the Memo, Hon'ble Mr.Justice G.Rajasuria, Former Judge of this Court, who was appointed as an Arbitrator by this Court's Order dated 28.07.2023 in this Arbitration Original Petition (Com.Div.) No.292 of 2023, has expressed that due to medical grounds, he is unable to act as an Arbitrator. 2.In view of the same, this Court will have to appoint a new Arbitrator in the place of Hon'ble Mr.Justice G.Rajasuria, Former Judge of this Court.

3.Therefore, (a)this Court appoints the Hon'ble Mr.Justice K.Ravichandra Baabu, Former Judge of this Court, residing at 1D, Crescent Castle, 13/6, II Cresent, Park Road, Gandhi Nagar, Adyar, Chennai-600 020 (Mobile No.9498033336) as the Sole Arbitrator to adjudicate the dispute between 1/2 https://www.mhc.tn.gov.in/judis

vga the petitioner and the respondents arising out of the Agreement dated 20.06.2022, on merits and in accordance with law. (b) The new Arbitrator appointed by this Court shall be paid remuneration/fees as per the schedule agreed upon by the parties to the dispute.

(c) The Arbitrator shall adhere to the provisions of Arbitration and Conciliation Act, 1996.

(d) The Arbitrator shall also pass the arbitral award within the stipulated period as prescribed under the Arbitration and Conciliation Act, 1996.

(e) Both the parties shall share equally the fees payable to the arbitrator.
