PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents to disburse the pending monetary benefits of the petitioner's husband late sudaresan by considering the petitioner's representation dated 16.03.2021. The writ petition has been instituted to issue a writ of Mandamus, directing the respondents to disburse the pending monetary benefits of the petitioner's husband Late Sundaresan by considering the petitioner's representation dated 16.03.2021.

2. The case of the petitioner is that the petitioner's husband Late Mr.Sundaresan was worked in the Primary Agriculture Co-operative Credit Society, Sarvamaaniya Puthur, Serkazhi, Mayiladuthurai District from the year 1987 to 2007. The petitioner's husband was died on 25.12.2007, while on his duty. After the demise of the petitioner's husband, the Management of

the Co-operative Society is not inclined to disburse the monetary benefits to the petitioner. In this regard, the petitioner made several representations to the respondent-Management. But the respondent-Management has not considered any of the representations submitted by the petitioner. Hence, the petitioner is constrained to move the present writ petition.

The learned counsel for the petitioner submitted that the petitioner was given a representation on 16.03.2021 to the respondents 1 and 2, requesting to pay the pending monetary benefits of the petitioner's husband Late Sundaresan, who died in the year 2007. He further submitted that the said representation was not considered by the respondents 1 and 2 till date.

4. The learned Government Advocate appearing for the respondents submitted that the representation of the petitioner dated 16.03.2021 will be considered on merits by the respondents 1 and 2 within a stipulated time that may be fixed by this Court.

5. Heard both sides.

6. In view of the submission made by the learned counsel on either side and without going into the merits of the matter, the respondents 1 and 2 are directed to consider the representation of the petitioner dated 16.03.2021 on merits and in accordance with law and pass appropriate orders within a period of six (6) weeks from the date of receipt of a copy of this order.

7. Accordingly, the writ petition stands allowed with the above directions. No costs.
