The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6 (a) of Cigarette and other Tobacco Products Act, 2003 and Section 328 of IPC, in Crime No.186 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that A1 and A2 were found in possession of 46 Kgs of banned tobacco products. It is further alleged that the petitioner herein is a whole seller of those tobacco products. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with A1 and A2. Only on the confession statements of A1 and A2, he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that A1 and A2 were in possession of 46 Kgs of tobacco products. On the confession of A1 and A2, the respondent found that the petitioner is a whole seller of the ceased tobacco products. He further submitted that the petitioner is having 10 previous cases. 5. Taking into consideration the facts and circumstances of the case and the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
