This application is filed by the defendants 3, 4, 5 and 7 to grant leave to defend their case in the present suit.

2. It is seen that already the applicants/ defendants 3, 4, 5 and 7 have lost their right to file the written statement. Since they had not filed the written statement within 120 days from the date of receipt of summons, as per the Commercial Courts Act, their right to file written statement was forfeited. However, the applicants/ defendants 3, 4, 5 and 7 have got the right to cross examine the plaintiff's side witnesses but, they cannot let any evidence. However, if they want to mark any documents, they can always mark the same through plaintiff's witness provided that the plaintiff's witness admits the same.
