PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 1st respondent herein to give police protection to the petitioner herein to construct the building in S.No.274/6, situated at Sorancheri Village, Poonamallee Taluk, Tiruvellore District. For Petitioner : M/s.T.Gnana Banu.

ORDER

This Criminal Original Petition has been filed to direct the first respondent to give police protection for construction.

2. The learned counsel for the petitioner submitted that the petitioner has sent a complaint on 13.08.2021 through Registered Post to the 1st respondent, but no action taken so far. Hence, the present petition seeking Police Protection. He further submitted that the respondents 2 to 5 had attempted to put up a church adjacent to the petitioner's land, which was objected by the petitioner. had filed a Civil Suit in O.S.No.149 of 2021 before the Principal District Munsif Court, Poonamallee for permanent injunction and the same was dismissed on 27.07.2015. Thereafter, no appeal has been filed as against the same and hence, the said order of the Civil Court had become final. Now the respondents 2- 5 had indulged in for the same act of putting up the construction of a church.

3. The learned Government Advocate (crl.side) submitted that the complaint said to have been sent through Registered Post on 13.08.2021 has not been received by the respondent police, for which, no postal acknowledgement is produced.

4. In view of the same, the petitioner is directed to appear before the respondent police and hand over the copy of the complaint dated 13.08.2021 along with the documents, which he relies upon. Thereafter, the respondent police is directed to take appropriate action as per law.

5. With the above directions, this Criminal Original Petition is disposed of.
