This is the Second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 28.09.2021 for the offences punishable under Sections 8(c) r/w 20 (b)(ii) (B), 22(c), 25 and 29(1) of NDPS Act, 1985 and Sections 147, 148 of IPC in C.C.No.38 of 2022 on the file of the learned Special Judge I Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai.

2. The case of the prosecution is that the petitioner and other accused were found in possession of 1.500 Kgs of Ganja and Nitrovit - 10 tablets totally 1125 tablets (876 grams) illegally. Hence, a case was registered as against the petitioner.

3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.11335 of 2022, on 13.06.2022, considering the fact that petitioner's arrest was shown in PT Warrant in Crime No.1999 of 2021 on the file of the H5, New Washermenpet Police Station and the petitioner failed to fulfill the twin conditions as contemplated under Section 37 of NDPS Act, 1985.

4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
