Respondent Prayer:- Second Appeal has been filed under Section 100 C.P.C., against the judgment and decree dated 02.02.2019 in A.S.No.203 of 2017 on the file of Principal District Judge, Vellore reversing the decree and judgment dated 06.11.2017 in O.S.No. 1 of 2015 on the file of Principal Subordinate Judge, Vellore.

JUDGEMENT Today, when the matter taken up for hearing, both the appellant and respondent appeared along with their counsels. As the case is pending from the year of 2015 and the suit is arising out of sale agreement, both the parties wanted to settle the issue amicably. Accordingly, the matter was settled between them for a sum of Rs.5,50,000/- including the sum of Rs.1 lakh deposited by the respondent/plaintiff in the suit before the Principal Sub-Court, Vellore and the respondent/plaintiff is directed to pay the said amount within a period of three months from the date of receipt of copy of this order.

2. In the result, this Second Appeal is disposed of out of settlement arrived between the parties before this court. No costs. Consequently, the connected Miscellaneous Petition is closed.
