Application No. 3810 of 2022 in C.S. No. 366 of 2021 C.V.KARTHIKEYAN, J.

This application has been filed seeking to condone the delay of 31 days in filing the written statement along with the counter-claim. In the affidavit filed in support of the said application, it had been stated that most of the papers were not available in USA and were in Triplicane and therefore, instructions should not be given to the counsel to prepare written statement along with counter-claim.

2. In view of the reasons stated and in view of the fact that it is only appropriate that the Court should examine all the issues raised by the parties, the delay is condoned. The plaintiff to file reply statement.

3. Registry may list the suit for filing of issues after the reply statement is filed by the plaintiff.
