O R D E R

This writ petition has been filed for the issue of writ of Mandamus directing the respondent to consider the representation dated 06.04.2023 wherein the petitioner had requested the respondent to collect the tax that is due and payable and to enable the petitioner to get the fitness certificate and to ply the vehicle.

2. Heard Mr.K.Subash, learned counsel for the petitioner and Mr.A.M.Ayyathurai, learned Government Advocate for respondents.

3. The case of the petitioner is that the vehicle tax was supposed to be paid on 01.04.2022. However, the petitioner was suffering from some illness and as a result, the tax was not paid. The petitioner thereafter made a representation to the respondent requesting the respondent to collect the tax dues to enable the petitioner to get the fitness certificate and ply the vehicle. Since the same was not considered, the present writ petition has been filed

before this Court.

4. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the respondent to inform the petitioner the total tax amount that is due and payable by the petitioner with penalty and interest. Once, the petitioner pays this amount, the respondent shall consider granting the fitness certificate after inspecting the vehicle and thereafter, the petitioner can ply the vehicle.

5. This writ petition is disposed of in the above terms. No costs.
