Petition under Article 226 of the Constitution of India praying for issue of a Writ of Certiorarified Mandamus to call for the records issued by the 2nd respondent bearing Ref. Na.Ka. E3/5196/2014 dated 29.10.2015, quash the same and consequently direct the respondents to issue sale deed inthe name of the legal heirs of late Chinnappan.

The petitioner has come forward to challenge the impugned order, which is only an enquiry notice, on the sole ground that only the 4th respondent has been called for the enquiry, as against the other legal heirs of the deceased father of the petitioner, namely, Chinnappan.

If that is the grievance of the petitioner, then it is well open to him and other legal heirs to approach the 2nd respondent and putforth their case.

Thus, the writ petition is disposed of giving liberty to the petitioner and other legal heirs to approach the 2nd respondent and putforth their case. Even otherwise, it is well open to the 2nd respondent to issue notice to other legal heirs before passing final orders pursuant to the notice dated 29.10.2015. Appropriate final orders will have to be passed by the 2nd respondent, as indicated above, within a period of eight weeks from the date of receipt of a copy of this order.
