A.No.3277 of 2023 in C.S.No.231 of 2021 N.SATHISH KUMAR. J., This application has been filed seeking to permit the applicant to receive death certificate of late C.Sathiyanarayanan dated 17.06.2021 and Form 26 AS of the applicant company for the assessment years 2018-2019, 2019-2020, 2020-2021 and 2021-2022 as additional document in addition to documents filed along with the plaint.

2. Though counter has been filed disputing the reasons assigned for filing documents at this stage, on overall perusal of the affidavit as well as the counter, this Court is of the view that documents are absolutely necessary for effective adjudication of the issue between the parties. Therefore, the documents will be received subject to the proof and relevancy.

It is open to the respondent/defendant to raise objections as to the admissibility of the documents during the cross examination.

3. Accordingly, this Application is ordered. The Registry is directed to post this suit before the Additional Master - III for recording evidence on 04.12.2023.
