This petition has been filed seeking for transfer of investigation in Crime No.110 of 2024, pending on the file of the 1st respondent police to CBCID.

The petitioner/de-facto complainant's son died on 16.04.2024 and in this connection, a complaint has been registered on 17.04.2024 on the information given by the petitioner alleging that the respondent-police is not properly investigating the case and it is a case of suspicious death, where his son was found dead near the building, where he was staying and the police has registered the case, as if his son fell down from the 27th floor in a drunken state leading to his death.

3. The learned counsel for the petitioner on referring the postmortem report submitted that it could not be an accident fall from the 27th floor, but somebody must have pushed his son and there was a quarrel between his son and the brother of his lover on the previous date of incident. 2/5

4. The learned Government Advocate (Crl. Side) submitted that the postmortem report and the viscera report indicates that the petitioner had fallen from the 27th floor on the cart gated fell in the floor and due to which impact was on his ribs and ribs were broken causing his death. The viscera report also indicates the presence of alcohol. The doctor has opined that he has died due to multiple injuries sustained by him. Therefore, on completion of investigation, RCS has been filed and a copy of the same was also served to the petitioner/de-facto complainant on 21.05.2024.

5. In view of the fact that investigation has been completed; final report has been filed and RCS notice has also been served on the petitioner, it is open to the petitioner to file protest a petition, if he is of the opinion that there is something else left in the investigation.
