2. On 20.04.2015, this Court passed an order dismissing the case as civil in nature on the premises that it is a landlord and tenant dispute. The matter was mentioned before this Court and posted today. Today, the learned counsel for the petitioner brought to the notice of this Court that the complaint dated 19.12.2014, from which, it is clear that the petitioner's father was a tenant and after the death of the petitioner's father, the landlord is refusing to return the lease advance amount to the petitioner. Even CSR No.824 of 2014 states that it is an allegation of cheating.

3. Under these circumstances, the respondent police is directed to conduct enquiry on the petitioner's complaint dated 19.12.2014 in CSR No.824 of 2015 and take action in accordance with law, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1.
