This Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus forbearing the respondents from transporting high tension line through petitioner's land at S.F.No.548 A-3, A-2 and A-3, P-2 (old S.F.No.548) in Ilakkamanaickenpatti Village in Kangeyam Taluk of Tiruppur District by considering the representation of the petitioner dated 25.07.2014.

O R D E R

The petitioner has filed this writ petition seeking to issue a writ of Mandamus forbearing the respondents from transporting high tension line through petitioner's land at S.F.No.548 A-3, A-2 and A-3, P-2 (old S.F.No.548) in Ilakkamanaickanpatti Village in Kangeyam Taluk of Tiruppur District by considering the representation of the petitioner dated 25.07.2014.

In the counter affidavit filed by the 2nd respondent in paragraph No.3 states that the Existing LT Line have been laid through the petitioner's land (Old S.F.No.548 Ilakamanickanpatty Kankeyam Taluk of Tiruppur Dist) on 25.02.1970 itself and on receipt of two applications have been registered for the load of each 3 HP in the name of Tmt.Palaniyammal W/o.Veerasamy at SF No.549/B Ilakamanickan Patty Village on 03.04.2014 and 15.04.2014 respectively. Based on the said applications, estimate was prepared as per Board Norms by replacing the Higher size pole in the existing route of the aforesaid applications. But, in the counter, subsequently, denied the contention of the petitioner and stated that no proposal of installing new Transformer for laying High Tension line through the petitioner's land. The said fact has also communicated to the petitioner on 10.07.2014. Therefore, nothing survives in the writ petition for further adjudication.

3. Recording the aforesaid statement, this writ petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
