ORDER
This writ petition has been filed to direct the 1st respondent to expeditiously effect necessary correction in the IFHRMS system management thereby resolve the issue of non-reconciling of balance as on 01.04.2021 relating to the accounts of the IV Add Sub Court @ Ponneri and direct the 3rd respondent to dispose of my representation dated 28.04.2023.
2. The learned counsel for the petitioner would submit that they have deposited a sum of Rs.25,00,000/- to the Account of IV Additional Sub Court, Ponneri, whereby a suit in OS.No.143 of 2019 was pending. The said suit was disposed of in terms of the compromise memo entered between the parties. Thereafter, the petitioner herein was permitted to withdraw the aforesaid amount. However, the accrued interest was not paid to the petitioner. Hence, this petition.
3. On the other hand, the learned counsel for the 4th respondent would submit that the said amount was not deposited in bank account but it was
deposited to the credit of Court and the same was kept in Treasury. Hence, the petitioner is not entitled for any interest. Therefore, he prays for dismissal of this petition.
4. In reply, the learned counsel for the petitioner seeks liberty of this Court to workout his remedy in the manner known to law.
5. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.
6. In view of the above, it is clear that the petitioner's amount was deposited to the credit of Court and the same was kept in Treasury. Hence, the petitioner is not entitled for any interest. Therefore, by considering the submission made by the petitioner as well as respondent, this Court is inclined to dismiss this petition. Accordingly, this writ petition is dismissed. No cost. The petitioner is granted liberty to approach any appropriate forum and work out his remedy in the manner known to law.
