ORDER

This writ petition is filed for the following relief: "directing the respondents to pay difference in Gratuity and Leave Salary with pension arrears based on increased Grade Pay and revised pay as per 12(3) settlement dated 04.01.2018 with 10 percentage interest to the petitioner."

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner joined the service of the respondent corporation as Conductor on 29.02.1984 and retired on 31.05.2015 as a Checking Inspector. Subsequently, the 12(3) Wage Settlement was entered into between the Management and the Trade Unions on 04.01.2018, pursuant to which the wages and pension were also revised with effect from 01.09.2010. Since the petitioner had retired on 31.05.2015, he is entitled to the difference in leave salary, gratuity and pension arrears as per the 12(3) Wage Settlement. Accordingly, the petitioner submitted a representation seeking the difference in leave salary and gratuity as per the 12(3) wage settlement dated 04.01.2018. However, the said representation has not

been considered so far.

In view of the above, the respondent is directed to pay the applicable differential amount of leave salary, gratuity to the petitioner along with the pension arrears in accordance with the 12(3) Wage Settlement dated 04.01.2018, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.

5.With the above direction, this Writ Petition stands allowed. No costs.
