This petition has been filed to modify the condition imposed on the petitioner to appear before the Ethapur Police Station, Salem instead of appearing before the respondent police in the above Crl.O.P.No.22772 of 2021 dated 30.11.2021.
2. The learned counsel for the petitioner submitted that the petitioner is duly complying the condition imposed on him by this Court to appear before the respondent police daily at 10.30 a.m. until further orders by an order dated 30.11.2021. However, when a petition was also filed to modify the said condition, it was informed that he was arrested in another Crime No.178 of 2022. Subsequently, he has filed a petition seeking to grant bail in Crl.O.P.No.12831 of 2022 and this court also granted bail on condition to appear before the Ethapur Police Station daily evening at 05.00 p.m. Hence, the petitioner is not able to continue the compliance of condition to report before the respondent police until further orders and in view of the same, the respondent police is taking 1/3
steps to cancel the bail granted to the petitioner. Therefore, he has filed this petition to modify the condition.
3. The learned Government Advocate (Crl. Side) would submit that now the charge sheet has been filed in C.C.No.58 of 2022 and there is one previous case pending against the petitioner. Hence, he vehemently opposed to modify the condition imposed by this court.
4. Considering the above submission, the condition to report before the respondent police is modified to that effect that the petitioner shall report before the Trial Court regularly without fail and the petitioner need not appear before the respondent police daily.
5. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 22772 of 2021 vide order dated 30.11.2021 shall remain unalterted.
