ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offences punishable under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act in Crime No.875 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that based on the information received from the secret informer about illegal selling of banned Ganja products, the respondent police arrived at the crime place and secured 1.4Kgs of Ganja from other accused persons A1 and A2, whereas the petitioner escaped from the scene. On further investigation, it was found that the petitioner and other accused persons were family members and they purchased the Contraband from Andhra Pradhesh and sold it in the open market. Hence, the respondent police registered a case against the petitioner and other accused persons. https://hcservices.ecourts.gov.in/hcservices/

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and his name was not found in the FIR. He further submitted that based on the confession made by other accused persons, he has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate submitted that the entire family was involved in illegal trading of banned contraband and there is no previous case pending against the petitioner. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the facts and circumstance of this case and the fact that the entire family was involved in illegal trading of banned contraband, this Court is not inclined to grant bail to the petitioner.
