ORDER

The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents to pay difference in leave salary, difference in Gratuity and Pension arrears as per 15th wage settlement dated 29.05.2025 with 10 percentage interest to the petitioners.

The case of the petitioners is that they joined in the service of the respondent Corporation as Drivers, Conductor and Helper Trainee, respectively and retired from service holding the posts of Driving Instructor, Special Grade Driver, Traffic Inspector and Foreman, respectively on attaining the age of his superannuation. It is submitted that subsequent to their retirement, a settlement was entered into between the Union and the Management dated 29.05.2025, which was made applicable with effect from 01.09.2023. However, the terminal benefits have been settled to the petitioners as per the pre-revised pay instead of revised pay. Hence, the petitioners submitted that they are entitled to the benefit under the said settlement dated 29.05.2025 along with interest at the rate of 10% and they had submitted a representation to the respondents on

06.04.2026 to pay the difference along with interest. Since the same was not considered, the present Writ Petition has been filed. 3.

Heard both sides and perused the materials available on record.

4. The stand of the petitioners cannot be disputed. In view of the 15th Wage Settlement arrived at under Section 12(3) of the Industrial Disputes Act, 1947, which entitles the employees of the Transport Corporation to revision of pay including gratuity and encashment of leave, the respondents are directed to pay the eligible differential amount in leave salary and gratuity as per the said Settlement dated 29.05.2025, along with interest at the rate of 6% per annum. The amounts shall be paid to the petitioners within a period of six (6) weeks from the date of receipt of a copy of this order.

5. In the result, the Writ Petition is disposed of with the aforesaid direction. No costs.
