Alamelu, Advocate Crl.RC.No.530 of 2021 (Revision Petition against the Judgment passed in Crl.A.No.58 of 2020 dated 03.03.2021 by the IV Additional District and Sessions Court, Bhavani, Erode District, confirming the order of the learned Judicial Magistrate -I, Bhavani, Erode District made in STC No.446/2019 dated 10.02.2020 convicting the petitioner U/s. 138 of N.I Act to undergo simple imprisonment for a period of one year and shall pay compensation of Rs.4,00,000/- indefault to undergo simple imprisonment for a period of two months and set aside the same by allowing the above CRl.R.C. P.Mathivanan .. Petitioner /vs/ Murugan ..Respondent

This case is taken up for settlement before the Lok Adalat. Both the parties are present. Mr.Deepan Uday, learned counsel for petitioner and Mr.M.Prakash Raj, learned counsel for respondent is present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT This criminal revision petition has been filed against the Judgment made in STC No.446/2019 on the file of the Judicial Magistrate -I, Bhavani, Erode District dated 10.02.2020 confirmed in Crl.A.No.58/2020 on the file of the IV Additional District and Sessions Judge, Bhavani, Erode District dated 03.03.2021.

2. Both the parties are present and it is agreed between the parties that a sum of Rs.4,00,000/- mentioned in the cheque was already paid by the petitioner in Crl.R.C.No.530/2021 to the respondent by cash.

3. The Compromise Memo duly signed by both the parties is filed before this Court and the same is recorded.

4.Since the matter is compounded, the judgment in Crl.A.No.58 of 2020 dated 03.03.2021 by the IV Additional District and Sessions Court, Bhavani, Erode District and the judgment of the learned Judicial Magistrate -I, Bhavani, Erode District made in STC No.446/2019 dated 10.02.2020 are set aside.

5. Recording the terms of the compromise memo filed by the both parties, the Criminal Revision Petition is disposed of. P.Mathivanan Counsel for the petitioner Murugan Counsel for the respondent

This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the petitioner in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
