Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order of the 1st respondent in Letter No. 67114/CMPC/2013-1 Finance (CMPC) Department dt 8.1.2014 and quash the same and direct the respondents to revise the Pay Band and Grade Pay for the posts of Skilled Assistant Grade I Special Artisan and Supervisor as requested in the petitioners representation dt 31.10.2013 and grant all consequential benefits to the members of the petitioner Union. The claim of the writ petitioner for revision of Pay Band and Grade Pay for the post of skilled assistant Grade-I, Special Artisan and Supervisor, was rejected by the respondents in proceedings dated 08.01.2014.
2. The petitioner is Tamil Nadu Motor Vandigal Paramarippu Niruvana Thozhilalar Sangam. Regarding the revision of Pay Band and Grade Pay, the aggrieved employees have to approach the Court of law. That apart, the Government through impugned letter dated 08.01.2014 replied by stating that as per the One Man Commission constituted for rectification of pay anomaly, the claim of the petitioners were not considered for revision. Thus, the Government rejected the claim for revision of Pay Band and Grade Pay for the post of Skilled Assistant Grade-1, Special Artisan and Supervisor, in other words, the Government was of the opinion that there is no anomaly in respect of the Pay Band and thus the claim of the writ petitioner was rejected. That apart, the Association cannot maintain a writ petition with reference to the individual grievances for revision of Pay Band and Grade Pay.
3. This being the facts and circumstances, if at all any individual member of the petitioner Association is aggrieved, they are at liberty to approach the competent authorities in the manner known to law.
4. With the above observation, the writ petition stands disposed of. No costs.
