..Respondent PRAYER : Writ Petition filed Under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to quash the proceedings dated 22/03/2019 in O.Mu.No.2205/2018/A4 on the file of the respondent and consequently direct the respondent to issue Class I Legal Heir Certificate of the deceased S.R.Kamalammal to the petitioner on the basis of the enquiry report submitted by the Village Administrative Officer, dated 01.03.2019 and the report submitted by the Revenue Inspector dated 01.03.2019. O R D E R

The writ petition has been field in the nature of mandamus, to set aside the proceedings dated 22/03/2019 in O.Mu.No.2205/2018/A4 on the file of the respondent namely the Tahsildar, VOC Nagar, Chengalpet Taluk and consequently direct the respondent to issue legal heir certificate with respect to the deceased S.R.Kamalammal died on 27.03.2004, leaving behind the following legal heirs:

2. It is further stated that the petitioner's father Veerasamy was the only son of S.R.Kamalammal predeceased on 10.08.1999. The death certificate has also been issued by the Revenue Department. The Legal Heirship certificate has also been issued by the Tahsildar on 31.07.2003. Thereafter, the petitioner had applied for the legal heirship certificate for S.R.Kamalammal who died on 27.03.2004.

3. It is stated by the learned counsel for the petitioner that the respondent had conducted a fresh enquiry in December 2019 and it is stated that a report is also been prepared.

4. In view of that fact, the impugned order dated 22.03.2019 is set aside and a direction is issued to the Tahsildar, VOC Nagar, Chengalpet Taluk who is the respondent herein to issue legal heriship certificate based on the enquiry made by him and the legal heirship certificate should be issued on or before 15.03.2020.

5. With the above observation, this writ petition is disposed of. No costs.
