This petition is filed under Section 378 (4) Cr.P.C, to grant leave to file an appeal against the order of acquittal made in Crl.A.No.57/2019 on the file of the learned Principal Sessions Judge, Tiruppur dated 14.12.2021 in reversing the conviction and sentence made in C.C.No.256/2013 dated 27.04.2019 on the file of the learned Judicial Magistrate, Avinashi.

2. Heard Mr.V.Prabhakaran, learned counsel for the petitioner.

3. Learned counsel for the petitioner contended that though the trial court by a well considered order convicted the accused for the offence punishable under Section 138 of the Negotiable Instruments Act the appellate court reversed the findings despite the fact that the accused had admitted his signature on the cheque. According to him, there are arguable points in the main appeal and therefore, leave is granted as prayed for.
