PAZHUR, UDAYARPAYAM TALUK ARIYALUR DISTRICT Vs SARAVANAN [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit the petitioner to withdraw the deposit amount of Rs.1,27,500/- (Rupees One Lakh Twenty Seven Thousand Five Hundred Only) along with interest amount from the Trial Court OS NO.175 of 2017 on the file of Sub Judge, Jeyamkondam IN CMP No.13896 of 2019.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.P.RATHINAVELU, Advocate for the petitioner and of M/S.S.T.P.KUILMOZHI, ADVOCATE on behalf of the Respondents the court made the following order:- By a conditional order dated 14.02.2019, the petitioner was directed to deposit 50% of the arrears of maintenance amount within a period of six (6) weeks.
2. It is stated that pursuant to the said order a sum of Rs.1,27,500/- has been deposited to the credit of the suit in O.S.No.175 of 2017 on the file of Sub-Court, Jeyankondam. The petitioner/ wife has come up with this petition seeking permission to withdraw the said amount.

3. Considering the fact that the amount in deposit represents the arrears of maintenance payable to her, this petition is allowed, the petitioner/wife is permitted to withdraw the sum of Rs.1,27,500/- deposited pursuant to the order dated 14.02.2019 to the credit of O.S.No.175 of 2017 on the file of the Sub-Court, Jeyankondam.
