This writ petition has been filed for the issue of writ of Mandamus directing the 3rd respondent to cancel the joint patta based on the representation made by the petitioner on 07.03.2019.

Mr.Annai Ezhil, learned Government Advocate appearing on behalf of the respondents 1 to 3, submitted that the 3rd respondent has already called the petitioner for an enquiry on 17.12.2020. The learned counsel submitted that the petitioner can be present at the time of enquiry along with all relevant document. The learned counsel further submitted that after conducting an enquiry, the report shall be furnished before the 2nd respondent and the 2nd respondent will pass orders in accordance with law.

Taking into consideration the facts and circumstances of the case and also of the fact that the 3rd respondent has already called the parties for an enquiry, there shall be a direction to the 3rd respondent to conduct an enquiry and to submit the report before the 2nd respondent, within a period of six weeks from the date of receipt of a copy of this order. The 2nd respondent on receipt of the report, shall pass orders strictly in accordance with law within a period of four weeks thereafter.

This writ petition is disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
