PRAYER:

Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to call for the records in C.C.No.77 of 2006 on the file of the Judicial Magistrate Court No.II, Vellore and quash the same.

O R D E R

This Criminal Original Petition is filed to call for the records in C.C.No.77 of 2006 on the file of the Judicial Magistrate Court No.II, Vellore and quash the same. 2.The second petitioner and the second defacto-complainant are present. It is submitted that the dispute between them has been resolved and they also reported that the statement to the first respondent, who had also taken note of it. The petitioners herein are tried the charges against them. Final report has been filed against them under Sections, 102, 103 and 107 of the Trade Marks Act, 1999 r/w Section 420 of the Indian Penal Code, Section 34 of the Indian Penal Code and Section 109 of the Indian Penal Code and the first respondent has filed a charge sheet against the petitioner in offence under Section 102, 103 of the Trade Marks Act, 1999 and 109 of the Indian Penal Code.

3.The dispute between the petitioners and the defactocomplainant is a commercial dispute, which has been now resolved and settled between them amicably. To that effect letters dated 09.08.2018 have been sent by the second petitioner as well as the defacto-complainant to the Deputy Superintendent of Police, District Crime Branch, Vellore and letter dated 16.08.2018 has been sent by the third petitioner to this Court informing about the settlement arrived between them.

4.The learned Government Advocate appearing for the first respondent had also admits the same.

5.In view of the above, the case in Criminal Original Petition is hereby stands quashed. Consequently, the connected Miscellaneous Petition is closed.
