Respondent in both WPs PRAYER: These Writ Petitions came to be numbered under Article 226 of the Constitution of India by way of transfer of O.A.Nos. 3538 and 3539 of 2003 from the file of Tamil Nadu Administrative Tribunal with a prayer to issue a Writ of Certiorarified Mandamus, to call for the records pursuant to the impugned Punishment Order issued by the respondent in Se. Mu. Aa. No. Pa2/8672/2001 dated 28.02.2003 and quash the same and to consequently direct the respondents to grant all monetary and other consequential service benefits and to issue a Writ of Certiorari calling for the records pursuant to the impugned charge memo issued by the respondent in memo No. Pa2/4574/2003 dated 07.05.2003 and quash the same and to pass such other orders.

O R D E R

The petitioner filed two Original Applications, one against the impugned order of punishment dated 28.02.2003 imposing stoppage of increment for five years without cumulative effect and other O.A. 3539/2003 challenging the charge memo dated 07.05.2003 issued under Rule 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules.

2. The record shows that there is no order of stay granted either by learned Tamil Nadu Administrative Tribunal or https://hcservices.ecourts.gov.in/hcservices/

this Court. The non-grant of stay would clearly show that by this time, the enquiry would have been completed. That apart, there is no representation for the petitioner for the past two hearings and even today.
