This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 04.05.2024, seeking bail in Crime No.317 of 2024 for the alleged offences punishable under Sections 354(c) of IPC r/w 67(A), 67(B) of Information Technology Act, 2000.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and due to a prior dispute that arose during the temple festival, the de facto complainant made a false complaint against him. He further submitted that the petitioner has been suffering incarceration from 04.05.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for granting bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected to grant bail to the petitioner stating that the petitioner/accused morphed the photographs of the de facto complainant's wife taken during the festival and with an intention to outrage her modesty, uploaded the same on social media. He further submitted that the investigation in this case is still pending and therefore, if the petitioner is released on bail at this stage, there is a possibility of him absconding and would threaten the witnesses.

4. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) and perused the materials available on record including the Case Diary produced by the respondent Police.

5. Taking into consideration the submissions made by the learned Government Advocate (Criminal Side) that the investigation is at initial stage and also considering the conduct of the petitioner/accused, this Court is not inclined to grant bail to the petitioner.
